I have acted in a wide variety of cases relating to IT and telecomms, involving

intellectual property

competition and regulatory issues

data protection

contractual disputes and negotiations.

Intellectual property cases have included 

domain name disputes such as fcuk.com, victor888.com, bernardmatthews.co.uk, arsenalfc.co.uk, KCTS.com, lanware.info, brahmakumaris.info, business.co.uk, bounce.co.uk, numberone.com, myspace.co.uk, wiseinsurance.co.uk, sussexsafetywear.com/co.uk, trucklife.com/co.uk, domainregistry.biz and many other cases 

infringement of copyright in the use of photographs on the internet (Antiquesportfolio.com v Fitch)

passing off in relation to branding of ISP products (World Online v Iomart - Freedom 24

false first-mover claims (Localtel v Greatxscape). 

I am also a WIPO and Czech Arbitration Court panelist for domain name disputes.

Competition and regulatory matters have concerned 

screen-scraping for price-comparison and service integration

restrictions on the use of GSM gateways

pricing of access to sports fixtures data

discrimination against parallel imports of computer hardware

pricing of interfaces in computer-telephony integration

the powers of electricity companies to provide telecomms infrastructure and services.

In the field of data protection I have advised on 

the marketing of additional services by utilities

the export of data outside Europe

surveillance of internet usage by employees and 

arrangements for market surveys.

I have acted in many contractual disputes relating to the supply of computer systems, typically involving 

differences as to what requirements were specified

whether the requirements were met and 

the validity of exclusion and limitation clauses. 

Other issues have included the scope of licences and the duties of website designers (Antiquesportfolio v Fitch). I have also advised in and conducted negotiations for substantial IT contracts.
